Vacation entitlement for part-time work: How to correctly calculate your days off
In a 1-day week, the legal minimum Holiday entitlement in Germany is four days per calendar year. This calculation is based on the Federal Holiday Act (BUrlG), which sets the annual minimum holiday at 24 working days, for a six-day working week. For part-time employees working less than six days per week, the holiday is calculated proportionally.
Here's a simple calculation example: If you work one day per week, divide the 24 working days by six and multiply the result by the days you work per week. So: 24 / 6 x 1 = 4 days of Holiday entitlement per year. This gives you four days of holiday with a 1-day week.
This minimum entitlement can be extended by collective bargaining agreements or company regulations. Some companies provide more holidays than the law prescribes. Company agreements and specific employment contracts also play a role. Individual agreements between employer and employee can also exceed the legal minimum holiday but must at least meet the legal requirements.
It is also important that the Holiday entitlement does not automatically expire. If you cannot take the holiday in the current calendar year, it can usually be carried over until March 31 of the following year. After this, however, it expires unless there are special reasons why the holiday could not be taken.
